Spirit: US 9th Circuit Court Throws Out Law Protecting American Musical Acts |
The Constitutionally Contested United States 9th Circuit Court has made another bogus ruling this week to allow "open" plagiarism by artists in the United States against foreign intellectual property owners, this time siding with UK musical act "Led Zeppelin" over United States musical act "Spirit", apparently based in Los Angeles, in a plagiarism case over the origins of the song "Stairway To Heaven" by Led Zeppelin.
Led Zeppelin wins part of plagarism case:
The 9th Circuit Court falls under the United States West Coast jurisdiction and has been a continous thorn in the side of Washington D.C. politics for decades, continuously making unconstitutional rulings in favor of corrupt government defense contractors.
This time the 9th Circuit Court in California I am assuming has thrown out a law that protects copyrights in Hollywood itself, home of most the entertainment business and leaving artists open to direct plagiarism of their works music or not I am assuming.
In California the court has thrown out the "substantial similarity" law, known as the "inverse ratio rule", they are saying which is used by some courts but not all.
Going by the reputation of the US 9th Circuit Court I'm assuming they mean that the band Spirit will win the case under appeal to higher US Courts and have just placed a "financial roadblock" against artists by allowing plagiarism to occur under the jurisdiction of the lower United States Courts, plaintiffs with less money will not be able to afford to appeal to the higher courts to win their cases giving the victories to people accused of plagiarism in the lower courts in yet again another unconstitutional ruling in the United States Courts.
Again, this means that if someone plagiarizes you and you live in California that if you have no money you will automatically lose, then if you have no money to appeal to the higher courts in the United States you will lose your copyrighted material in the unconstitutional ruling.
This automatically gives the case a victory to UK musical act "Led Zeppelin" if the band Spirit has no money for appeals in the Los Angeles courts.
Why this case is proceeding against Led Zeppelin in California is because the band Taurus is from Los Angeles and have to sue locally against the defendant Led Zeppelin in the UK.
The lower United States 9th Circuit Court this time has awarded the case to foreign musical Led Zeppelin in the UK, under the new laws in the lower United States Courts you are now allowed direct plagiarism to an extent in the United States only, which can then be appealed to higher courts by people who get infringed upon.
My plagiarism case which I am no rush to proceed with falls under Halifax, Canada jurisdiction laws and is not affected by this ruling in the lower United States court system.
What they are saying is that they have thrown out the "accessibility" laws in plagiarism cases because of the internet allows anyone access to all other material for newer cases, the Led Zeppelin case is older well before the internet, but everyone knows Led Zeppelin had access to the Spirit material because they were on tour together in the 1960's apparently.
The other sections they threw out were if a song is plagiarized along with artwork similarities like in my case that is no longer valid.
Another rule for copyright infringement cases was using similar place names or places in the lyrics along with the music to prove plagiarism which I believe they are saying was thrown out.
They also said that they "allowed" for several similar notes to be used anyway and not be considered plagarism.
What that means is inside the United States only is you are now allowed to copy several notes from someone else's song in the same progressions, use similar artwork as well the the same names and places in the lyrics.
Sounds like to me more like they are running a Record Label instead of a court room in the US 9th Circuit and protecting their infringing artists just like they are protecting the illegal Government Defense Contractors in the United States.
In my case which does not fall under their jurisdiction they are allowing my songs to be plagiarized under the lower United States Courts jurisdiction if they use the first several notes in a progression, as well as similar art, names and places like in my court case.
In Canada, this only makes my case easier to win here in Halifax against a Los Angeles defendant because the laws protecting the other people are unconstitutional in the lower United States Courts and had no jurisdiction in Canada.
So now my case also includes in my lawsuit a section where I am suing them for protecting the other artists by using an unconstitutional law in the United States which also has no jurisdiction in Canada or any other Country outside the United States.
Using well known heavy metal musical act "Metallica" as an example of how the law can know be applied you are now allowed copying their songs on your album but only in the United States and under the lower 9th Circuit Court which is protecting plagiarists in the lower courts but not the higher ones.
In this ruling for example you are now allowed using the first four notes of the song "Metallica - Enter Sandman" as well as their "old man" artwork, lyrical locations, and direct "black style" cover art all at the same time in the unconstitutional ruling in the home state of Metallica, California, as well as many other artists.
The rule they just set in the low 9th Circuit Courts is that you can use their artwork and lyric themes as well as the first four notes in the same sequence of songs like "Enter Sandman" if you change the last notes.
What they mean is in a five note progression like start of the song "Enter Sandman" in the United States and change the last note or add extra notes to the songs to change the ending of the progression, like the song would have the same first four note progression and a different fifth note or added notes at the end, and you are also allowed copying their artwork image style and lyrical place and name content they are saying.
On the internet this formula is commonly known as the "Metallica Scale" and there are instructional videos on websites like Youtube to teach people how to write songs in this fashion based on the works of musical act Metallica.
Obviously, all this is unconstitutional but that's what is all over the music news today on the internet.
